This page is general information about how we work. It is not legal advice.
These Terms & Conditions apply to the website projects, Care Plans and related services provided by Patryk & Michelle Webs. Each project is also described in a written proposal or agreement. If that agreement says something different from these Terms, the written agreement applies.
1. Services
Patryk & Michelle Webs (“we”, “us”) designs and develops custom websites for businesses (“you”, “the client”). We offer four website products: Starter, Business, Premium: The Visual Experience (“Premium”) and Premium Business, along with optional add-ons and ongoing Care Plans. The scope of each project, including what is and is not included, is set out in your proposal.
The website concepts shown on our website illustrate the style and depth of each product. They are conceptual examples, not client work, and they do not define the exact deliverables of any project.
2. Pricing
Our published prices are in US dollars: Starter $1,200; Business $2,500; Premium $5,500; Premium Business from $7,500. Add-ons: additional page $200 per page (Starter, Business and Premium Business); additional revision round $150 per round (all products); WhatsApp contact button $50 (all products). Care Plans: Starter Care $79 per month, Business Care $149 per month, Premium Care $249 per month.
The price for your project is the one stated in your proposal. Work outside the agreed scope is quoted separately before it begins. Third-party costs, such as your domain, paid plugins, booking or payment tools, are not included unless your proposal says so.
3. Payment structure
Website projects are paid in two parts:
- First payment: a deposit, due before work begins. Your project is scheduled once the deposit is received.
- Second payment: the remaining balance, due upon delivery of the website.
We may hold the launch or transfer of the website until the final payment has been received. Care Plans are billed monthly in advance.
4. Client responsibilities
To deliver your project on time, you agree to:
- Provide accurate information about your business and your goals
- Supply the content and materials we need, such as text, images, logos, access details and third-party account information
- Review work and give consolidated feedback within a reasonable time
- Purchase and keep your domain and any required third-party accounts active
- Make sure your website’s content and your use of it comply with the laws that apply to your business
5. Client materials and content
You are responsible for the content and materials you provide. By providing them, you confirm that you own them or have permission to use them, and that they do not infringe anyone else’s rights. You allow us to use these materials for the purpose of creating, delivering and maintaining your website. We are not responsible for the accuracy of client-provided content.
6. Revisions
Revision limits apply according to the product you purchase. Starter includes two rounds of revisions; the revisions included in other products are stated in your proposal. A revision round is a single set of consolidated changes to the agreed design and scope. Unlimited revisions are not included in any product. Additional revision rounds are available for $150 per round. Changes that go beyond the agreed scope, such as new pages, new functionality or a new design direction, are quoted separately.
7. Delivery timelines
Our products are typically delivered within 5–7 business days once all required materials are available. Timelines begin when we have received the deposit and all required materials, and they may be extended by late materials, delayed feedback, additional revision rounds, changes in scope or third-party issues outside our control. Delivery estimates are good-faith estimates, not guarantees.
8. Domain responsibilities
Your domain is owned by you and paid for by you, annually, directly with your domain registrar. You are responsible for keeping it registered and renewed. We connect your domain to your website as part of our services, but we are not responsible for expired domains, registrar issues or loss of access to accounts that you control.
9. Hosting
Your website is deployed to a hosting service agreed with you. Where supported, hosting management is included in our Care Plans. Hosting providers operate under their own terms, and we are not responsible for their outages, pricing or policy changes. Any hosting costs are yours unless your proposal states otherwise.
10. Third-party services
Websites may rely on third-party services, such as form delivery, booking, calendar, payment, maps, messaging or email tools. These services are provided by their own companies under their own terms. We are not responsible for their availability, changes, fees, data handling or discontinuation, and we cannot guarantee that they will continue to work in the same way over time.
11. Care Plans
Care Plans provide ongoing maintenance and support for your website: Starter Care (1 hour per month), Business Care (2 hours per month) and Premium Care (3 hours per month). Starter websites pair with Starter Care, Business websites with Business Care, and Premium and Premium Business websites with Premium Care.
- Unused hours do not roll over to the following month.
- Major redesigns, major new functionality, complex development and cinematic productions are not covered and are quoted separately.
- Major work outside a Care Plan may be quoted separately.
- Hosting management is included where supported. Care Plans are maintenance and support plans, not hosting-only plans.
- Analytics are not included.
12. Cancellation and end of services
You may cancel a Care Plan at any time by written notice. Unless your agreement states otherwise, cancellation takes effect at the end of the current billing period.
Once the client relationship ends, including the cancellation of a Care Plan, the absence of a Care Plan, or the end of services for any other reason, Patryk & Michelle Webs is no longer responsible for ongoing website maintenance, operation, security, compatibility, availability, updates, third-party services, hosting, domain issues, performance or related matters, unless a separate written agreement states otherwise. From that point, continued maintenance and operation of the website belong to the client.
Repairs, updates, redesigns and additional functionality requested after services end may require a new agreement and additional fees.
13. Refunds
Refunds are handled according to the agreed service terms. Patryk & Michelle Webs does not provide refunds for completed services, for work already performed, or under the agreed cancellation conditions. Because the deposit secures your place in our schedule and covers work that begins immediately, it is non-refundable once work has started, unless your written agreement states otherwise. Care Plan fees already paid are not refunded.
14. Intellectual property
Once your project has been paid in full, you own the final, delivered website design and content created specifically for you. Until full payment is received, all work remains the property of Patryk & Michelle Webs. We keep ownership of our pre-existing tools, code, techniques and know-how, and grant you a license to use them as part of your website. Third-party elements, such as fonts, images, plugins or services, remain subject to their own licenses.
15. Portfolio usage
Unless you ask us not to in writing, we may display your completed website, and a description of our work on it, in our portfolio, on our website and in our marketing materials. We will never disclose confidential information you share with us. We only publish client testimonials based on real, approved client feedback.
16. Conceptual work
Website concepts, mockups and previews shown on our website or in proposals are conceptual illustrations. Businesses shown in them are fictional unless stated otherwise. Concepts are not client work and do not represent a guaranteed final result; the final design of your website is developed with you during the project.
17. Limitation of liability
We provide our services with care and professional skill. To the fullest extent permitted by law, Patryk & Michelle Webs is not liable for indirect, incidental or consequential damages, including lost profits, lost data or business interruption, arising from the use of or inability to use a website or our services. Our total liability for any claim related to a project is limited to the amount you paid us for that specific project or service. We do not guarantee specific business results, search rankings or uninterrupted availability.
18. Changes to services and these Terms
We may update our services, prices and these Terms from time to time. Changes do not affect projects already agreed in writing. The date at the top of this page shows when these Terms were last updated.
19. Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be handled by the competent courts located in the State of New Jersey, unless the law of your place of residence requires otherwise.
